Process & Systems Upgrade Program Rules V1.1 in effect

Program Rules V1.1 for the Process & Systems Upgrade Program (PSUP) became effective June 8, 2016 and are available here. The key changes allow for third party ownership of a behind-the-meter generation (BMG) facility within a host customer site. This will allow an LDC to enter into a contract with the third-party provider for local BMG. The third-party will be responsible to meet performance obligations under the contract.
Please note that the standard PSUP participant agreement should not be used for third-party contract arrangements. A sample participant agreement, specifically for third-party contract arrangements, has been developed by Toronto Hydro and will be posted on the LDC Extranet in the coming days. Please refer to the disclaimer prior to use.

For reference, the draft amended PSUP Rule was posted for comment from May 27 to June 3, 2016. LDCs were notified of the draft amended Rule being posted for comment through the June 1, 2016 E-BLAST. As of the end of the comment period two comments/questions were received, however they did not result in a change to the draft rule.
